These Terms & Conditions govern all services provided by Kearney Auto Restyling (“KAR,” “we,” “us,” or “our”). By scheduling or receiving any service you, the vehicle owner or authorized agent (“you”), agree to be bound by these terms.
1. Scope of Services
• KAR provides detailing, window tinting, vehicle wraps (full, partial, vinyl graphics), paint protection film (PPF), and related services. Specific services, prices, and time estimates are set at booking and may be adjusted on inspection.
2. Vehicle Condition & Disclosures
• You must disclose all known mechanical or cosmetic issues, hazards, or contaminants (e.g., loose batteries, inoperative windows, needles, fuel/chemicals). Failure to disclose known hazards makes you responsible for any resulting injury, cleanup, or additional charges.
• Remove personal items and loose valuables prior to service. KAR is not responsible for loss or damage to personal property left in the vehicle.
3. Safety & Refusal of Service
• KAR will not perform work that, in our judgment, risks vehicle damage or staff safety. We reserve the right to refuse or stop work at any time. If we cannot complete a service on arrival, your deposit may be forfeited per our cancellation policy.
4. Appointments, Deposits & Cancellations
• Appointments require a deposit to confirm. Deposits are due within 48 hours of booking or the appointment may be canceled.
• Changes or cancellations require at least 48 hours’ notice for full refund of deposit. Cancellations within 24–48 hours may forfeit a portion of the deposit. Cancellations within 24 hours of appointment are subject to the full deposit forfeiture or a cancellation fee equal to a percentage of the scheduled service, as quoted at booking.
• Multi-vehicle bookings are treated as separate appointments for deposit/cancellation purposes.
• KAR may place a temporary hold for the full amount of a scheduled appointment on the card provided up to 24 hours prior to service.
5. Pricing, Additional Charges & Payment
• Pricing is based on vehicle size, condition, and selected package. Extra charges apply for heavy stains, excessive pet hair, extensive debris removal, unsafe/hazardous cleanup, and any required additional labor or materials.
• For tint and wrap work, additional fees may apply for complex curves, prior aftermarket trim/equipment removal, damaged or corroded surfaces, or if extensive surface preparation is needed.
• Payment is due on completion. We accept cash and major credit/debit cards. Non-sufficient funds or returned-payment fees will be charged to the customer.
6. Tint & Wrap Specific Terms
• Compliance: You are responsible for knowing and complying with state/local laws regarding window tint darkness and reflectivity. KAR will advise on legal options but is not liable for fines, inspections, or required removals due to noncompliant aftermarket changes requested by you.
• Surface Condition & Preparation: Wraps and tint require appropriate surface condition. Old adhesives, paint damage, rust, dents, or previous paint-corrections can affect adhesion, appearance, and warranty. KAR may decline work or charge additional prep fees.
• Adhesion & Longevity: Wrap/tint adhesion and life depend on prior surface condition, installation environment, and vehicle use. We do our best to optimize adhesion but cannot guarantee indefinite adhesion or absolute resistance to lifting, bubbling, or edge failure, especially on poorly prepared or previously modified surfaces.
• Color/Finish Variations: Vinyl color, texture, and gloss may vary between production batches; perfect color match with existing parts is not guaranteed. Slight seams, overlaps, and panel transitions may be visible.
• Removal & Repair: Removal of wraps or tint installed by others may reveal pre-existing damage. KAR is not responsible for this damage. Removal fees apply; additional repairs are quoted separately.
• Aftercare & Warranty: KAR provides a limited warranty on workmanship for a specified period (stated on your work order). Warranties do not cover damage from accidents, improper aftercare, vehicle washing equipment (e.g., automated car washes), environmental contaminants (tree sap, bird droppings, industrial fallout), stone chips, road debris, vandalism, or neglect. Improper modifications after installation void the warranty.
• Heat & Environmental Effects: Vinyl and tint may react to extreme heat/cold and sun exposure; minor shrinkage, edge lifting, or adhesive change can occur. This is not automatically a defect.
• Consent to Cut/Trim: For fit and function, installers may need to tuck, cut, or lift trim, weather-stripping, or remove/reinstall simple fasteners. KAR will avoid major disassembly unless pre-approved in writing. KAR will not remove or reinstall child car seats, structural components, or complex aftermarket electronics without explicit prior authorization.
7. Property Damage, Liability & Indemnity
• KAR will exercise reasonable care. However, you agree KAR, its owners, employees, agents, and affiliates are not liable for minor cosmetic issues or for pre-existing conditions aggravated by service.
• For major damage directly caused by KAR’s proven gross negligence or willful misconduct, KAR’s liability is limited to, at KAR’s option, repair costs or the vehicle’s fair market value immediately prior to the service. KAR must approve any third‑party repair vendor prior to payment.
• You agree to indemnify and hold KAR harmless from any claims, losses, costs, or damages (including attorney fees) arising from services provided, your failure to disclose hazards, or your breach of these terms.
8. Photographs & Marketing
• By accepting service you grant KAR permission to photograph or video the vehicle for marketing, portfolio, and social media purposes, unless you provide written notice refusing such use prior to service.
9. Post-Service Inspection, Touch-Ups & Claims
• Inspect the vehicle at completion. Notify KAR within 24 hours of any issues not noted at final inspection; schedule any touch-up within 2 business days. Claims made after 24 hours may not be covered.
• KAR is not responsible for issues that arise after service completion due to subsequent use, environmental exposure, or third-party intervention.
10. Dispute Resolution & Governing Law
• These terms are governed by the laws of the state in which KAR performs the service. Disputes should first be raised in writing to KAR for informal resolution. If unresolved, disputes may be subject to mediation then binding arbitration, except where prohibited by law.
11. Miscellaneous
• No guarantee is made to return a vehicle to “like-new” or “showroom” condition. Results depend on initial condition and scope of service.
• KAR reserves the right to amend these terms; the posted terms at the time of service govern each job.
• If any provision is unenforceable, the remainder of these terms remain in effect.
